Following 11 liens placed against D Flag T LLC, the owner of the planned TownePlace Suites by Marriott along Route 66, a judgment in Coconino County Superior Court has called for the property to be auctioned off by the Coconino County Sheriff’s Office.

Signed by Coconino County Superior Court Judge Brent Harris on Jan. 31, the default judgment against defendants D Flag T LLC, Akal Development Inc. and Jaspal Singh Sidhu states the parcel at 2000 E. Route 66 will be sold in order to settle the roughly $105,000 notice and claim of lien filed by Geary Pacific Corporation in July 2024.

“The lands and premises directed to be sold by this decree are situated in the county of Coconino,� the judgment from Harris reads, �... and are particularly described as follows, to wit: 2000 East Route 66, Flagstaff, AZ.�

The civil lawsuit filed by Geary Pacific Corporation in September 2024 is one of just four filings in which D Flag T LLC is the defendant.

Though one case, brought by Independent Electric Supply, was dismissed with prejudice against 12 defendants in January, two others filed in 2025 remain. Vanguard Builders AZ LLC and Premier Project Management LLC filed civil lawsuits against numerous defendants, including D Flag T LLC, in January and February respectively, seeking to foreclose their liens filed in 2024.

While Premier Project Management is seeking $70,181.22, Vanguard’s lien is $594,025.27, as the liens detailed with the Coconino County Recorder’s Office total thousands of dollars. The most recent lien from early February -- which was amended from its original filing from November 2024 -- cites $934,960.73 due to the claimant, Overland Construction Corporation.

Though Overland Construction’s legal representation declined to comment on the pending lawsuit, the court filing notes that the TownePlace Suites by Marriott was officially considered completed in October based on Arizona statute citing 60 consecutive days of labor stopping.

“The project was abandoned, and labor on the project ceased for nonpayment, on Aug. 13, 2024. Work on the project has not resumed since abandonment,� the filing stated. “Such cessation of labor was not due to a strike, shortage of materials or act of God. As a result � the date of completion of the building, structure or improvement, or any alteration or repair of such building, structure or improvement was Oct. 11, 2024.�

According to the judgment, the court found D Flag T LLC, Akal Development and Sidhu were served, failed to respond, and failed to appear or answer Geary Pacific Corporation, leading to the order for payments and to sell the property.

Numerous contractors and subcontractors filed liens or were named as potential codefendants in the civil cases, but D Flag T LLC, Akal Development and Sidhu are the only parties with judgments to pay as of March 8. D Flag T LLC, which shares an address in Frisco, Texas, with Galaxy Hotel Group -- which was also named in one of the liens -- bought the property from FLG Hospitality Inc. for $2.4 million in December 2021, according to Coconino County records.

Located at the site of the former Wonderland Motel, which was demolished in the summer of 2018, the space remained vacant until work began on the proposed TownePlace Suites by Marriott four years later in the summer of 2022.

According to the sheriff’s office, a written order signed by a judge had not been brought to the office along with the judgement as of the first week of March, so potential auction date for the property was not clear.

In addition to the liens and the judgement, D Flag T LLC owes Coconino County $18,056.71 in property taxes as of March 8, according to the Coconino County Treasurer’s Office. With the first payment of taxes due by Nov. 1, 2024, the property at 2000 E. Route 66 is currently delinquent based on Arizona statue, with the second payment date recently passing on March 1.
